This is to also minimise any risk to the integrity and/or security of your personal data. All the data is stored in accordance with GDPR practices.

EK will ensure that any third-party processor has adequate data protection measures in place that align with the requirements of the GDPR. EK will not share your data with any third-party processor outside of the UK, EU or USA.

EK will not sell your personal data or other information to any third-party without you written consent.

EK stores personal information on a secure CRM database which is shared with our associated companies named above.

Although data is stored centrally, all communication is segmented between the separate companies. We may on occasion share content between these companies when we believe the information will be relevant and valuable.

 

  1. Retention Period

EK will only keep your personal data for as long as necessary for the purposes for which it was gained. Personal data will be retained for the purposes of maintaining and/or developing a professional relationship or where we have another legal basis for processing (such as your consent or a contract with you).

EK will review the personal data we hold on you every 12 months to check for accuracy and relevancy and to ensure that we continue to have a legal basis for processing.

If the personal data is no longer necessary, or where we no longer have the legal basis for processing, we will delete or fully anonymise the data we hold on you, in line with our GDPR Policy. If your data becomes inaccurate, we will update it accordingly.

You may contact EK or any of the associated companies listed (see Recipients of Personal Data) any time to have your personal data removed and deleted from the specific company records. All such requests will be actioned within 30 days of receipt in writing.

Emmerson Kitney Ltd will retain your personal data to assisting you with work finding services for a period of 24 months. Different laws require us to keep different data for different periods of time.

 

The Conduct of Employment Agencies and Employment Businesses Regulations 2003, require us to keep work-seeker records for at least one year from the date of their creation or after the date on which we last provided you with work-finding services. Upon expiry of that period the Company will seek further consent from you. Where consent is not granted the Company will cease to process your personal data and sensitive personal.

 

We must also keep your payroll records, holiday pay, sick pay and pensions auto-enrolment records for as long as is legally required by HMRC and associated national minimum wage, social security and tax legislation.

 

Where Emmerson Kitney Ltd has obtained your consent to process your personal data, we will do so in line with our data retention policy (see above). Upon expiry of that period the Company will seek further consent from you. Where consent is not granted the Company will cease to process your personal data and sensitive personal.

All information received from us shall be treat as highly sensitive and confidential. Therefore, this information should not be controlled or processed by any employee, associated business or third party that is not involved directly with the recruitment process. Typically, this would include;

  2. Hiring or Line Manager
  3. Accounts/ finance Department (only for processing payment of invoices)
